These Terms of Use (the "Terms") form a binding agreement between you ("you") and TripWave ("TripWave", "we", "us", or "our"), the operator of tripswaves.com(the "Service"). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.
Plain-English summary (informational only — the full clauses below control):TripWave is a free travel-comparison and editorial site that earns commissions from booking partners (Booking.com, TripAdvisor, Expedia, Skyscanner). You can use it for personal, non-commercial trip planning. Don't scrape it, don't resell our data, don't abuse the affiliate links. We don't guarantee prices or availability — those come from third parties and change in real time.
1. Eligibility
You may use the Service only if you can form a binding contract with TripWave under applicable law. The Service is intended for users who are at least 16 years old. If you are under 16, you may use the Service only with the involvement and consent of a parent or legal guardian. We do not knowingly collect personal data from children under 16; if you believe a child has provided us personal data, contact [email protected] and we will delete it promptly.
2. The Service
TripWave aggregates and presents travel-related content (flights, hotels, car rentals, destinations, editorial guides). Bookings, prices, inventory, reviews, and policies displayed on TripWave are provided by third-party travel suppliers and partner networks. TripWave is not a travel agent, tour operator, or seller of travel. We do not own, operate, control, or take payment for any travel inventory shown.
When you click an affiliate link, you leave TripWave and are subject to the terms, conditions, and privacy practices of the destination site. Any contract you form is directly between you and the third-party supplier.
3. Account registration
Some features (saved trips, wishlists, custom itineraries) require an account. When you register you agree to:
- provide accurate, current, and complete information;
- keep your password confidential and not share access;
- notify us promptly of unauthorised use at [email protected];
- accept responsibility for all activity under your account.
We may suspend or terminate accounts that violate these Terms, are inactive for 24+ months, or appear to be operated by automation.
4. Permitted use
You may use the Service for personal, non-commercial trip planning and research. You may share individual links to TripWave content via standard social channels.
5. Prohibited conduct
You agree NOT to:
- scrape, crawl, or harvest content programmatically other than via our public sitemap;
- use the Service to build a competing product, dataset, or model (including AI training);
- circumvent rate limits, authentication, or access controls;
- artificially inflate clicks, impressions, or affiliate commissions;
- upload or publish unlawful, defamatory, or infringing content;
- impersonate another person or misrepresent your affiliation;
- introduce malware, run denial-of-service traffic, or interfere with infrastructure;
- reverse-engineer or attempt to extract source code or commercial data;
- violate any applicable law, export-control regulation, or third-party right.
6. Intellectual property
All content on TripWave that is not licensed from a third party — including text, code, design, layout, logos, and the "TripWave" name — is owned by TripWave or its licensors and is protected by copyright, trademark, and other applicable laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for the permitted purposes above.
Photographs are licensed from Unsplash and similar providers and remain the property of their respective photographers (credited where shown). Hotel, flight, and other travel data is the property of the respective supplier.
7. Affiliate disclosure
TripWave participates in affiliate programs operated by Booking.com, TripAdvisor, Expedia, Skyscanner, and other travel partners. We may earn a commission when you book through one of our links — at no extra cost to you. See our Affiliate Disclosure for full FTC §255 details.
8. Third-party links and content
The Service contains links to third-party sites and embeds third-party content (booking partners, image providers, etc.). We do not control or endorse those sites or their content and we are not responsible for them. Use of third-party services is at your own risk and subject to their terms.
9. Pricing, availability, and accuracy
Prices, fees, taxes, availability, dates, schedules, and supplier policies shown on TripWave are provided by third parties and change frequently. We cache and display this information in good faith but make no warrantythat it is complete, accurate, current, or available at the time you click through. Always confirm details on the supplier's site before booking.
10. Disclaimer of warranties
The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all warranties including merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability.
11. Limitation of liability
To the fullest extent permitted by law, TripWave, its officers, employees, contributors, and affiliates are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenues, data, goodwill, or alternative travel arrangements, arising from or in connection with your use of the Service — even if we have been advised of the possibility of such damages.
Our aggregate liability to you for direct damages arising from these Terms or the Service shall not exceed EUR 100 (or the equivalent in your local currency).
Some jurisdictions do not allow the exclusion of certain warranties or limitation of certain damages, so some of the above limitations may not apply to you. Nothing in these Terms excludes liability that cannot lawfully be excluded — including, in the EU, liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.
12. Indemnification
You agree to indemnify and hold harmless TripWave from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Service, or your violation of any law or third-party right.
13. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to TripWave or other users. You may stop using the Service and request deletion of your account at any time by emailing [email protected].
Sections that by their nature should survive termination — including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law, and these Miscellaneous clauses — survive termination.
14. Changes to the Service or these Terms
We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. We may revise these Terms; the version in force is always the one published at tripswaves.com/terms. Material changes will be flagged on this page and (where you have an account) by email at least 30 days before they take effect. Your continued use after the effective date constitutes acceptance.
15. Governing law and dispute resolution
These Terms are governed by the laws of the Republic of Armenia, without regard to its conflict-of-laws rules. The courts of Yerevan have exclusive jurisdiction, except that consumers resident in the EU, UK, or other jurisdictions with mandatory consumer-protection rules retain the right to bring proceedings in their local courts and to rely on the protections of their local consumer law.
EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
16. Miscellaneous
These Terms together with the Privacy Policy, Cookie Policy, and Affiliate Disclosure form the entire agreement between you and TripWave concerning the Service. If a court finds a clause unenforceable, the remaining clauses stay in force. Our failure to enforce a right is not a waiver. You may not assign your rights under these Terms without our written consent; we may assign ours freely (e.g., on a sale of the business).
